The Issue and Periodization of Research on the History of State and Law in Ukraine

The article considers the range of relevant issues of formation of the Ukrainian state and law in the context of a fundamental transformation of society and the state in contemporary conditions, analyses the scientifi c achievements on the periodization of the history of state and law, proposes possible approaches to periodization of modern history of state and law in Ukraine, raises the issue of organizing and implementation of a comprehensive study thereof. The author states that the historical past of Ukraine, including the history of state and law, evidence the long struggle of the Ukrainian people for their future. The national statehood was formed in extremely diffi cult and often tragic circumstances. Ukrainian historical and legal science has come a long way of growth and development. The article pays special attention to the fact that in contemporary conditions there is an urgent need to systematize the scientifi c achievements, historical and legal assessment of the positive achievements, current problems and errors of the time of independence. The need to study political and legal transformations in Ukraine in the late twentieth century, the problems of forming a sovereign state and national legislation, the establishment of legislative, executive and judicial branches of government, central government and local government, law enforcement, state and non-state actors of the security sector, constitutional and administrative reform, rights and freedoms of man and citizen, etc. is essential for further development of society and the state. Based on analysis of processes of state formation and development of national legislation and law, author proposes for consideration the following periodization of recent history of state and law in Ukraine: 1) 1990–2004 – «period of formation of Ukrainian statehood and rights», when the legal basis of the national state was formed, the Constitution of Ukraine and amendments thereto were adopted, system of state and local government bodies, courts, law enforcement agencies, armed forces and other military units was implemented, radical socio-economic transformations were carried out and market economy was formed, civil society institutions were created, etc. 2) 2004–2014 – period, which is conventionally proposed to defi ne as «period of missed opportunities». At this time, the different political forces that came to power, proclaimed a number of important reforms aimed at further development of society and the state, European and Euro-Atlantic integration of Ukraine. At the same time, author emphasizes the fact that most intentions, plans and programs aimed at reforming various sectors of society and the state have not been implemented; 3) since 2015, we have historical background to the new period, which could potentially be «period of national revival and development of Ukraine». According to the author, this will happen and become successful pursuant to joint efforts of civil society, government, political and business elite aimed at for common achievement of the country development goals.
