In the article general theoretic characteristic of a principle of a proportionality of interpretation of law is carried out and its ability to be restrictive means from abuse by the interpreter of the authority to interpret restrictions of the individual rights is analyzed. Moreover, balancing elements through which this principle disclose are investigated: «public interest – private interest», «private interest – private interest», «restriction or preference – the purpose», and characteristics of the principle of proportionality are considered also.
