The article is devoted to the analyze of the problem of criminal policy formation in the field of counteraction to enemy propaganda during the war. This research covers the massacre of suppressed propaganda in Ukraine, which encroaches on the basis of national security, public order and security, as well as peace, security of mankind and international law and order. Countering enemy propaganda has become a sensitive and pressing problem in Ukraine through its aggressive influx, starting in 2014 (first russian occupation of Ukrainian territories) and even more significant in 2022 (second russian occupation of Ukrainian territories). Enemy propaganda during the large-scale aggression and war has become even more dangerous. Change and manipulation of the common thought, dissemination of false information all over the world, imposition of the enemy’s ideology by means of aggression, encroachment on the basis of national security, peace, security of mankind and international legal order. The promotion of war can be seen as the “invitation” to commit war crimes, crimes against humanity and genocide. Collaboration activities (Part 3 of Article 111-1 of the Criminal Code of Ukraine), propaganda of war (Article 436 of the Criminal Code of Ukraine) and propaganda of the communist and national socialist (Nazi) totalitarian regime (Art. 436-1 CC of Ukraine) were named as enemy propaganda. The author paid attention to definition of propaganda and its negative impact on the people. An important part of the research was the fixation of the historical and legal place of propaganda. Another necessary part of the work was the demonstration of the connection between the propaganda of war and war and other international crimes. With this goal, the international nature of the propaganda and the approach of the UN to counter this phenomenon was indicated.
