Modern approach to improving the administrative-legal mechanism of reserve management in Ukraine

Abstract

The article is devoted to a comprehensive analysis of the current state of the administrative and legal mechanism for the management of state reserves of Ukraine and to identifying the main directions for its improvement under conditions of martial law and the transformation of the public administration system. The retrospective development of legislation in the field of the state material reserve and the reform of the central executive authority responsible for implementing state policy in this area are examined. Systemic shortcomings of the previous management model, in particular excessive centralization and insufficient procedural transparency that necessitated reform, are identified. Particular attention is paid to the provisions of the Law of Ukraine «On State Reserves» (2023) as the new legal framework for the functioning of the state reserve system. It is determined that the updated management mechanism requires further improvement, particularly through the development of detailed regulatory procedures. The study analyzes the institutional framework of reserve management, the division of powers between the Cabinet of Ministers of Ukraine, the Ministry of Economy of Ukraine, and the State Agency for Reserve Management of Ukraine, and identifies problems of institutional interaction. Special attention is given to the digitalization of the reserve system, the functioning of the Unified State Reserves Register, and the potential application of analytical tools, including artificial intelligence technologies, to enhance the efficiency and responsiveness of management processes. The necessity of optimizing procedures for the formation, renewal, and utilization of reserves is substantiated, as well as the introduction of a risk-oriented approach to planning the nomenclature of material assets and the establishment of legal grounds for storing reserves at the facilities of private economic entities within the framework of public-private partnership. Proposals are formulated to improve the administrative and legal mechanism of reserve management as a component of the national security system of Ukraine.
