Features of the interaction between the State agency for reserves management of Ukraine and local government bodies

Abstract

The article carries out a comprehensive study of the features of the interaction between the State Agency for Reserve Management of Ukraine and local self-government bodies in the context of the transformation of the public administration system, decentralization processes and the functioning of the state under martial law. The theoretical and legal principles of the interaction of public administration entities are studied, the content of the category of interaction as an administrative and legal phenomenon is revealed and its place in the mechanism of the implementation of public power is determined. The essence, features and principles of interaction between the central executive body in the field of state reserve management and local self-government bodies are analyzed. Special attention is paid to the characteristics of organizational and legal forms of interaction, among which coordination, information, control and resource forms of cooperation are distinguished. The administrative and legal status of the State Agency for Reserve Management of Ukraine is studied, its place in the system of executive bodies is determined, and the legal nature of local self-government bodies as independent subjects of public power is also revealed. The study conducted a systematic analysis of regulatory legal acts regulating the interaction of the above-mentioned entities, including the Constitution of Ukraine, legislation in the field of state reserves, local self-government and the legal regime of martial law, as well as subordinate regulatory legal acts. The features of the competence of the entities of interaction in the field of formation, storage and use of state reserves, as well as ensuring the vital activity of territorial communities were determined. The specifics of organizational and legal mechanisms of interaction in conditions of martial law and crisis situations were analyzed. It was established that in conditions of increased security threats, the transformation of public administration mechanisms is taking place in the direction of strengthening the centralization of management, expanding the powers of state authorities and increasing the role of military administrations in coordinating the use of state reserves. Key problems of interaction between the State Agency for Reserve Management of Ukraine and local self-government bodies were identified. Based on the conducted study, the author's proposals were formulated to improve the administrative and legal mechanism of their interaction.
