Discharging of a Judge for Violation of Judicial Oath and the Problem of Ensuring Judicial Independence

The author analyzes the procedure of dismissal of a judge for violation of judicial oath by the High Council of Justice with regard to compliance with the standards of due process. According to the legal opinion of the European Court of Human Rights, all procedures regarding judges in this body must comply with the principles of independence, impartiality, transparency, fairness, reasonable terms of process and ensure other safeguards of the right to trial.
