Legal security of Ukraine: concept and content

The problem of ensuring legal security is relevant for the current development of Ukraine in a transitional state of the national legal system, the introduction of systemic legal reforms on the path to European integration. The urgency of the scientific solution to this problem is explained by the lack of conventional views in legal science on the concept and content of legal security, the definition of epistemological, ontological bases and the introduction of scientific conclusions, recommendations in legal practice. The aim of the study is to reveal the signs, content of legal security, phenomenological features and the possibility of effective influence of legal security on national security of Ukraine in globalization, permanent hybrid threats to the existence of the Ukrainian state, national legal system. To achieve the goal of the study, both general and special scientific methods were used: dialectical, formal-logical, empirical, hermeneutic, comparative-analytical, methods of legal forecasting and legal modeling, etc. The use of phenomenological approach allowed to consider legal security in the context of understanding law as a social phenomenon with the definition of its essential features, values, including the value of security of human life, existence and development of society and the state. It is important in this process to emphasize that law, as a whole system, has the inherent properties of truth, stability, parity, predictability, compliance with moral and ethical rules, culture of society. The ideological dimension of law, where its essence is revealed, is the idea of law – justice, freedom, equality, legal certainty. The idea of law is realized in legal reality and needs appropriate protection, which provides legal security. Legal security has a dichotomous nature – ensures the implementation of the essence of law in legal reality, introduces the idea of law into social practice, eliminates defects of legal consciousness, legal culture and at the same time forms mechanisms to protect the national legal system from social factors and phenomena that threaten the legal system, lead to the destruction of its components, social, cultural, moral and ethical bases. Legal security in this case is considered as a type of national security, as a result of national security law, which is especially relevant in the context of global transformations of the world order.
