The actuality of the study of popular law-making and its forms is determined by the democratic transformations that are going on in Ukraine. Acquisition by Ukraine of the status of a candidate for the European Union’s member speeded up the implementation of the legal reform, the purpose of which is to bring the national legislation into conformity with acquis communautaire. However, the modernization of the national legal system should be carried out not only in accordance with international legal standards and EU law, but also taking into account national interests. The exponent of national interests is the Ukrainian people, therefore their participation in the law-making process is extremely important today, when various strata of society must be heard regarding the people’s position on Euro-Atlantic integration issues. The issue of popular law-making is directly a matter of the state’s constitutional and legal policy, which should conceptually present scientifically substantiated legal ideas regarding the need to involve civil society institutions in the law-making process and implement the whole its forms that are available in the civilized world. Therefore the peculiarities of the forms of popular law-making in foreign countries, fixed at the constitutional level, are analyzed in the article, namely: the adoption of normative legal acts of different legal force in the all-Ukrainian and local referendum; popular initiative (popular law-making and popular referendum initiative); local initiative; popular veto; popular discussion of draft regulatory acts; popular poll regarding normative legal acts; popular expertise of normative legal acts and drafts of normative legal acts. Taking this into account, the purpose of this study is to identify and ground the essence, content and forms of law-making of the Ukrainian people. The expected result of the study is the substantiation of the need to improve the mechanism of organizational and legal provision of broad participation of the Ukrainian people in the law-making process that will contribute to the improvement of the quality of national legislation and the level of legal life in general.
