The system of protection of private property from illegal encroachments in Ukraine contains a number of shortcomings that prevent effective protection of such property in our country. These shortcomings are caused both by the remnants of the Soviet system of property protection, which Ukraine received from the USSR, and by the transitional period of the formation of a market economy in Ukraine. The purpose of the article is to analyze the peculiarities of the right of property and the approaches to the formation of the system of its protection due to them, inherent in the USSR, which Ukraine received as a "heritage" from the Soviet past, which include the absence of private property, the right of individuals to independently protect their personal property, and the state's monopolization of protection functions property, expansion of the number and powers of state bodies, which were entrusted with such functions, to the detriment of the rights and interests of individuals, disrespect for personal property and the possibility of its protection formed in society. Authors group the features of the system of protection of private property from unlawful encroachments, formed in developed democratic countries, ensuring its effectiveness (limiting the ability of their employees to violate the right to private property, including establishing a ban on entering the territory of immovable objects, which are privately owned, for representatives of law enforcement agencies without judicial authorization) and the right of the individual to independently protect his private property. This study examines the transformation of the system of protection of private property against unlawful encroachments in Ukraine and the definition of its peculiarities, on the basis of which the author's view on further ways to improve the system of protection of private property against unlawful encroachments in Ukraine, taking into account the experience of developed democratic countries and internal challenges to the security of private property in the country during wartime and during the period of recovery after the end of hostilities is formulated. One way to improve respect for private property in society is to encourage responsible ownership. This includes raising awareness that protecting private property, including from unlawful encroachments, is the responsibility of the owner; elimination of certain remnants of the Soviet system of property protection, in particular, the monopolistic concentration of functions of the state to ensure such an aspect of public security as protection of property rights from unlawful encroachments in the hands of state law enforcement agencies; the elimination of the remnants of the transitional period of establishing the property protection system in Ukraine, defines the private security system as a strategic part of the country's public security system, and proposes the introduction of tax benefits for private security companies, especially those employing war veterans, including disabled veterans, who provide private property protection services; the organization of a training and retraining system for private security specialists should include former law enforcement and defense employees, war veterans (including disabled individuals) who possess the necessary knowledge and skills to ensure public safety. completion of the process of creating conditions for self-protection by the owner of his property, namely, legalization of the circulation of weapons (firearms and others) and legitimization of the activities of private detectives.
