A functional approach to achieving economic security objectives: EU experience and prospects for its incorporation into national legislation

Abstract

It is substantiated that it is of critical importance for Ukraine to take into account the EU’s experience in building a modern system of legal instruments and expanding the functions of existing tools for the implementation of economic policy, including in the area of economic security. It is emphasised that the paradigm shifts taking place in EU law as a result of geopolitical and geoeconomic upheavals demonstrate ideological transformations – from the absolutisation of the international legal order as a universal standard for organising global economic processes to the formation of a legal model of adaptive and compromise-based regulation of international trade relations, with the deliberate programming of desired outcomes, taking into account risks and their management. It is established that, in this context, the EU is undertaking a substantial revision of the purpose of legal constructions, expanding their functions and, accordingly, their regulatory potential. It is revealed that corresponding changes affect the institutions of public procurement, state aid and the legal regime of foreign investment, the capacities of which are relevant to the objectives of economic security. As a result, preconditions are created for ensuring economic resilience, based on value-oriented principles and the foundational elements of the concepts of “open strategic autonomy” and “technological sovereignty,” which have been incorporated into the current methodology for shaping the EU’s mechanism of proactive response to external and internal threats. It is argued that this will help prevent the development of Ukraine’s legislation in a direction contrary to contemporary trends in EU law, particularly with regard to the national model of localization in public procurement, which lacks selectivity and a focused concentration of state attention on specific sectors of the economy and cross-sectoral areas that are priorities for public policy, including in the field of national security.
